India Competition Law 2.0: Commitments and Settlements

The new settlement and commitment framework under the Indian Competition Act, 2002 is aimed at speeding up competition enforcement, particularly in digital markets, where timely enforcement is essential as markets can tip in favour of dominant players. The Competition Commission of India (CCI) has recently settled its first case with Google in the Android TV operating system market, bringing this case to an end much faster than many other cases before the CCI. However, critics point towards limitations and ambiguities in the legal framework that may impede the bringing of settlements and commitments. In this inter-disciplinary discussion with experts, we will explore different aspects of the settlement and commitment regime from a theoretical and practical lens and gain insights as to the role this framework is likely to play in India.
